All orders placed with Mr Cool It are subject to the following conditions of sale:
The names trademarks, images, logos, service marks appearing on our website and within any literature may not be used by any party other than Mr Cool It without prior authority.
Mr Cool It is a trading name for Us 4 Slush Limited.
Whilst every endeavour will be made to maintain the prices within the literature and live on the website, Mr Cool It reserves the right to alter prices at any time without prior notice. We also reserve the right to discontinue lines, change branding and prices without prior notice.
All prices stated in these terms and conditions, on the Mr Cool It website and within Mr Cool It literature are in Pounds Sterling and exclude Value Added Tax (“VAT”) at the relevant rate.
Payment for goods must be made in full before dispatch, unless a prior agreement has been made. Goods remain the property of Mr Cool It until paid for in full. If credit terms have been agreed and the customer fails to pay Mr Cool It the full amount due within the allotted duration of the credit term, the customer will be liable to pay interest on such sum from the due date for payment at the annual rate of 10% above the base lending rate of the Bank of England, accruing on a daily basis until payment is made, whether before or after any judgment. We reserve the right to claim interest under the Late Payment of Commercial Debts (Interest) Act 1998. The customer will also be liable for any additional third-party costs accrued whilst collecting the outstanding debt.
We do not supply any goods on a trial basis. It is important that the customer should always satisfy themselves as to the suitability of a product for their requirements before ordering.
Our policy is one of continuous improvement and therefore we reserve the right to change specifications to our products or services without notice.
In the event of a customer cancelling an order prior to dispatch, Mr Cool It will issue a refund within 14 days, minus an admin charge of 25% of the invoice total. Mr Cool It does not offer a refund on bespoke orders that are subsequently cancelled.
Returns and faulty goods
Perishable products are non-refundable and cannot be returned once dispatched.
Our returns policy applies to goods, which must be unused and as new, in their original and undamaged packaging (external & internal) and with all instruction manuals.
A customer wishing to return an item must email Mr Cool It within 7 calendar days of receiving the order, at the following address: firstname.lastname@example.org. Once email approval has been received from Mr Cool It, the goods may be returned, using a trackable service with a copy of the original invoice, at the buyer’s expense, provided the goods are undamaged, un-used and in their original undamaged packaging with all instruction manuals included. All returns will be refunded minus a 25% restocking fee, plus courier costs at a minimum of £20 for a consignment or £125 for a pallet. Please note that these courier costs will be charged irrespective of the order value. Refunds will be issued within 14 days.
Insurance must be arranged with the courier when returning goods to cover possible damage or loss in transit for the full value of the item.
Mr Cool It provides a return to base warranty for machines purchased in Great Britain, Northern Ireland and the Republic of Ireland.
Machines are supplied with the following return to base warranties from the date of invoice:
New slush machine (purchased with a Mr Cool It starter package) – 360 days
New slush machine (purchased without a Mr Cool It starter package)– 180 days
Reconditioned slush machine (purchased with a Mr Cool It starter package) – 90 days
Reconditioned slush machine (purchased without a Mr Cool It starter package)– 30 days
All installations must be carried out as instructed within the manufacturer’s installation manual, which is supplied with the machine.
The machine will be eligible for warranty repairs and service support during the specified time period, provided only Mr Cool It syrups have been used in the machine. The warranty will become invalid if any other syrup or product has been used.
The warranty does not cover any fault which is as a result of misuse, negligence, damage, modifications or repair by an unauthorised person. General wear and tear to handles, bowls, lids, drip trays and other plastic outer component parts, or issues caused by failure to follow the instructions for locating, operating, and cleaning the machine are not covered under warranty.
It is the customer’s responsibility to ensure any issue or problem is identified and reported to Mr Cool It immediately.
Should the customer require support during the warranty period, Mr Cool It can organise a courier to collect the machine on the customer’s behalf. Costs are from £60 each way. It is the customer’s responsibility, as the owner, to make sure the machine is safely packaged upright and secured on a pallet, with photographs having been taken ahead of collection.Mr Cool It reserves the right to charge a £150 diagnosis fee prior to looking at any machine under warranty. Once returned to Mr Cool It, the machine will be checked over as a priority and if it is deemed that the machine is at fault under warranty, a refund of the diagnosis fee will be issued within 14 days. If it is found that the machine has been damaged due to misuse, Mr Cool It reserves the right to charge for labour and parts to repair the machine accordingly.
Mr Cool It is not responsible for the provision of a replacement machine whilst repairs are being carried out or if a machine is returned to the manufacturer on the customer’s behalf.
Servicing & Repairs
All servicing and/or repairs carried out by Mr Cool It are completed at our workshop to ensure a high-quality of workmanship. We do not offer on-site servicing on any machine.
Once any servicing or repairs have been completed, a final invoice for any parts fitted and return courier charges will be provided. We will hold machine(s) for 28 days from the date of the invoice until payment is received. If payment is not received within 28 days of the invoice due date, Mr Cool It reserves the right to charge a storage fee of £5 per day until full payment of the invoice is received.
Once collected by the courier, the title and risk of any purchase is passed over to the customer.
We aim to deliver parcels to the majority of mainland UK on a next day courier service and pallets within 3 days, Monday to Friday. Orders placed by 12pm will be dispatched on the same day. Orders placed after this time and out of normal business operating hours will be dispatched the next working day. Express Saturday delivery and timed deliveries are available at an additional cost – the customer must notify Mr Cool It prior to ordering if one of these services is required. We will make every effort to deliver orders within the time scales indicated. However, the time and date of delivery are not guaranteed. The customer shall have no right to damages or to cancel the order for failure or for any cause to not meet any delivery time stated. If the shipment has been late leaving us, we will notify the customer with the reason why, and when to expect the delivery.
Deliveries are made via courier, Monday to Friday between the hours of 8am and 6pm. It will be the customer’s responsibility to inform Mr Cool It of failed deliveries of goods if they have not arrived when expected.
If an order is dispatched on a pallet, it is classed as kerbside delivery and will be delivered as close to the entrance of the delivery address as reasonably possible. Couriers are not obliged to enter or carry goods within the premises. It is the responsibility of the customer to ensure that, when taking delivery, someone is available to move the goods from the delivery point. All deliveries on pallets for heavy items such as machines will be unloaded on a tail lift and in these instances, delivery will be considered completed when the pallet is off the tail lift. It is the customer’s responsibility to inform us of any special delivery instructions at the point of order.
The customer must inspect the consignment and notify Mr Cool It of any shortages or damage within 24 hours of delivery. Do not sign for a consignment unless it has been thoroughly checked whilst the courier is on site. If this is not possible, indicate ‘unchecked’ at the point of delivery. Mr Cool It cannot support any potential claim if this information is not received within 24 hours. Mr Cool It organises courier deliveries on behalf of the customer.
Should the customer decide to accept a delivery of a consignment in damaged condition they must accept the courier’s signed delivery documentation and a claim cannot be made.
In no circumstances shall Mr Cool It be liable to compensate the customer by way of damages or otherwise for non-delivery or late delivery of the goods or any loss, consequential or otherwise, arising from late delivery or non-delivery.
Should the customer request the courier to leave a delivery in a ‘safe place’ the customer takes full responsibility for its safety. Neither Mr Cool It nor the courier is responsible for any missing consignments.
In the event of a delivery being attempted, but nobody is present to accept and sign for it, the consignment will be stored by the courier for no more than 3 working days. The customer must contact the courier to arrange a re-delivery. If this has not been done within the specified period the courier reserves the right to return the goods to Mr Cool It.
Goods returned to Mr Cool It will be held for 14 days. If no contact is made in this time period the consignment will be disposed of and no refund will be issued.
Should the customer request Mr Cool It to redeliver the goods, an additional delivery cost of £20.00 per box or £125.00 per pallet will be required, prior to the goods being released.
